Leicestershire Fire and Rescue Service is responsible for the enforcement of the fire regulations. Fire safety officers based at our four district fire safety offices make regular visits to businesses to make sure the regulations are complied with.
In workplaces which are subject to the fire regulations, if we consider that any provision of the regulations has not been complied with in respect of your workplace, or the employees who work there, we may take action against you. In workplaces used by more than one employer, a notice may also be served on any other person who has control, to any extent, over parts of the workplace. In very serious cases, which are a serious threat to life,
Leicestershire Fire & Rescue Service can serve you with a notice under section 10 of the Fire Precautions Act 1971. This can prohibit or restrict the use of your workplace until the risk to your employees or other people has been reduced. Failure to comply with it is a criminal offence. You can appeal against the notice to a magistrates' court but it will remain in force until such time as the court says otherwise.
A failure to comply with the fire regulations, which places one or more employees at serious risk in case of fire, is in itself, a criminal offence. In any proceedings for such an offence, it is a defense for people charged to prove that they took all reasonable precautions and exercised all due diligence to avoid the commission of the offence.
